December 18, Mr.Surasee Kosolnawin, the President of the Subcomittee of the National Human Rights Committee revealed that the National Human Rights Committee has already submitted the report on conclusion of the facts finding about the October 7, 2008′s rally dispersal to the National Counter Corruption Committee (NCCC). The 117-page report was gathered from 91 testifiers of 7 groups i.e., politicians group, mass media group, rallying people and injured people group, core leaders and PAD guards group, medical officers group, forensic medicine and forensic science experts group and police officers group. On December 19, there would be another additional interview by NCCC.
Two Type of Tear Gas
The conclusion by NHRC submitted to NCCC to indict the culprits in the Black October 7 ‘s rally dispersal in front of the House of Parliament, following the harmonious testimonies of the core leaders and PAD guards group who witnessed the rally dispersal, is the teargas explosives fired from Uthong Nai junction by police officers exploded in two ways.
The first type just released smoke. This type mostly bursted while in the air. The second type, about 70 per cent of all the teargas fired, exploded with flames. This type bursted on the ground and gave off flames.
Continuous Teargas Bombardments
The second part of the report is the statements by the rallying people and the injured which similarly testified the continuous teargas bombardments by police officers with a police repeatedly again and again speaking through a loudspeaker, “If they can stand, let them stay. Fire, fire, march on them, wade into them“, accompanying by frequent explosion noises. The people witnesses testified that they said, “We give up. We are unarmed.” Still, the same police officer with the loudspeaker said, “Police officers, you have to clear the road. Release everything. Let go of everything and clear the road.” He also stressed, “Police officers, your duty is to clear the road. Do you want to defy me?”
The third part is the statements by mass media. The fourth part is the statements by medical officers. The fifth part is the statements by forensic medicine and forensic science experts group and police officers group.
The sixth part is the statements by politicians group. The first to testify in front of the Subcomittee of NHRC is Somchai Wongsawat (PM then) who gave statements about the time and date of his position. He told that he was reported about the rallying people surrounding the parliament on October 7, 2008, the policy declaration date. He also told about how he was led out of the parliament by officers after the policy declaration.
In later part, it was the statements by Gen. Chawalit Yongjaiyuth who testified wholly according to what he had been reported by the police. The statements by Mr.Chai Chidchob, the Speaker of the House of Parliament, Miss Rosana Tositrakul, a senator, and Mr.Prasong Nurak, an appointed senator follow in the report.
The seventh part is statements by police officers group. Pol. Gen. Patcharawat Wongsuwan –Commander-in-Chief of the National Police Office — was the first to testify. He talked about the night of October 6th, 2008. At about 23:00 he was in a meeting with politicians, including Gen. Chawalit Yongjaiyuth — Deputy Prime Minister, Pol. Gen. Pracha Promnok, Pol. Gen. Kowit Watana — Deputy Prime Minister and Minister of the Interior, Mr.Warawut Silpa-archa, and some other forgotten names.
The statements of of Pol. Gen. Wiroj Paholvej — Deputy Commander-in-Chief of the National Police Office (Security and Special Tasks), Pol. Lieut. Gen. Suchart Muankaew — Commander of the Metropolitan Police, Pol. Maj. Gen. Anan Srihiran — Commandant of the Metropolitan Police Authority No.1, Pol. Maj. Gen. Puwadol Wuthakanok — Commandant of the Quartermaster and Ordnance Department, Pol. Maj. Gen. Chaitipoom Amnuaychai — Commandant of the 5th Company, 2nd Regiment, Police Special Operation Authority, Police Sub-Lieut. Kriangkrai Kingsami, Police Sergeant Nattanon Supamongkolcharoen — Troop Leader, 1st Company 2nd Regiment, Police Special Operation Authority, and others follow on the list.
Tear-gas Snipers
A lot of on-site witnesses of the rally dispersals which took place in front of the Metropolitan Police Headquarter and at the Statue of King Chulalongkorn plaza testifed that they saw police officers in the buildings, on the trees and on the walls of the Metropolitan Police Headquarter using firearms to shoot teargas canisters from within the Metropolitan Police Headquarter at the people walking pass Sri-Ayudhya road in front of the Metropolitan Police Headquarter to the Statue of King Chulalongkorn plaza, and at the people walking pass Rajdamnoen road beside the Metropolitan Police Headquarter to the Statue of King Chulalongkorn plaza, and at the people walking back to Makawan bridge, including the gathering and chatting crowd on the street.
Responsible for the Shattered Bones and Internal Crushed Organs
Collection of the forensic medicine evidences confirms people’s injuries, severe injuries, blast injuries, explosive wounds, or explosive forces, so severe that the bones were shattered and internal organs crushed. This report states that the polices to be responsible to the injuries and the deaths from the dispersal of the rally are as follows.

- Pol. Maj. Gen. Ekarat Meepreecha — Deputy Commander of the Metropolitan Police / Deputy Situation Commander of October 7, 2008 8am to 8pm and was authorized to control the mission on October 7, 2008 at 15:00 onward until the mission was finished.
- Pol. Maj. Gen. Jakratip Chaijinda – Deputy Commander of the Metropolitan Police / Deputy Situation Commander of October 7, 2008 8pm to 8am and was also authorized to assist Pol. Maj. Gen. Ekarat Meepreecha.
- Pol. Maj. Gen. Srivara Rangsipramkul — Commandant of Police Special Opeation, was authorized to assist area control.

Pol. Col. Luechai Sudyod (in the middle , the guy with a hood),He ran from the third row throwing a tear gas bomb aggressively and then hid back behind other police.
Pol. Col. Luechai Sudyod – Commandant of Police Special Opeation, was authorized to assist control, was throwing teargas grenades into a lot of people. Being an expert with knowledge and experience in mob control, he is supposed to very well know the methods for mob control and usage of teargas.
- Pol. Maj. Gen. Amnuay Nimmano — Deputy Commander of the Metropolitan Police — held a press release, presenting fabricated falsified statements, such as, the shattered legs of the protesters were because of their own ping-pong grenades, or trips and falls over barbed wire. He confirmed that polices did not possess such explosives to cause the injuries because the Commander-in-Chief of the National Police Office and the Commander of the Metropolitan Police had clearly ordered the only use of shields with some additional clubs. However, the photos in massmedia disprove Pol. Maj. Gen. Amnuay’s statements as teargas explosives both firing launch type and manual launch type, shotguns, pistols, MP5 guns used in military battles are displayed. Such fabrication of falsified statements created misunderstanding in the public and may be criminal offences as abuse of his authority to cover up unlawful actions of other police officers and possible infliction against innocent protestors to unlawfully subject them to criminal offences.
- The control force which possess teargas explosives are Police Special Operation Command unit, Border Police Headquater and Crime Suppression Department.
Bloody Line of Command
On October 6, 2008 during 8pm to 8am Pol. Lieut. Col. Montri Srithong and Pol. Lieut. Col. Wiwat Boonchaisri commanded Police Special Operation Command unit. Pol. Lieut. Col. Chatmongkol Ponpai and Pol. Capt. Kasem Wiengnak commanded Border Police. Pol. Lieut. Col. Suriya Yupaet commanded Crime Suppression.
On October 7, 2008 during 8am to 8pm Pol. Col. Somchai Patra-into, Pol. Lieut. Col. Chaiporn Boonchom, Pol. Lieut. Col. Xomchai Suantitapanya and Pol. Maj. Ekachai Yuenyao commanded Police Special Operation Command unit. Pol. Col. Nat Sing-udom commanded Border Police. (mounted a stand in the parliament).
On October 7, 2008 during 8pm to 8am Pol. Lieut. Col. Montri Srithong and Pol. Lieut. Col. Wiwat Boonchaisri commanded Police Special Operation Command unit. Pol. Lieut. Col. Chen Songdej and Pol. Capt. Pisanuwat Jaikan commanded Border Police. Pol. Col. Sirames Pantamanee and Pol. Maj. Chinchot Chotsiri commanded the Metropolitan Police Headquarter’s perimeter.
Ambushing/Sniping confirmed by Mass Media Testifiers
Several people and mass media testifiers confirmed ambushing/sniping from within the walls of the Metropolitan Police Headquarter. The police officers inside must be responsible for violation of human rights as well as the violation of criminal laws articles 157, 295, 297, 288, 289, 83 because of abusing of authority, inflicting damages and injuries to others, murder and attempt to murder with premeditation.
House Meeting could has been postponed
From the interview of politicians, the conclusion stated that Somchai Wongsawat, PM then, testified that before the October 7′s policy declaration, there had been a resolution that the House Speaker would notify any necessity to postpone the house meeting. Whatever was scheduled should be as scheduled. If postponed, he must be informed before hand. The meeting agreed that the house meeting should be at the parliament first. If it cannot be entered, it would be up to the House Speaker to order later.
Gen. Chavalit volunteered to take charge
Gen. Chawalit Yongjaiyoot volunteered to take charge of the rally since he said that he had already talked to the police. He, by himself, would control and command the police and asked the polices who were waiting for instructions to return to the situtation observation posts. Somchai, therefore, did not talk or order police officers. As well, he was unaware of any of Gen. Chawalit’s talk or commands.
On the other hand, Deputy Prime Minister Gen. Chawalit testified to the Senate subcommittee that the Prime Minister ordered him to be responsible which he did not say anything. He was authorized to guard the parliament from arson and to make possible the meeting. Any rally was to be driven away to make possible the meeting. Then, Gen. Chawalit went to the Metropolitan Police Headquarter with several followers. On arrival, he held a meeting which Commander-in-Chief of the National Police Office Pol. Gen. Patcharawat Wongsuwan was also present.
The NHRC subcommittee agrees that Pol. Gen. Patcharawat, Pol. Gen. Wiroj and Pol. Lieut. Gen. Suchart similarly testified to confirm that there had been the already handed-down October 6, 2008 ‘s cabinet’s resolution demanding the parliament’s meeting definitely on October 7, 2008.
PM Somchai: I was not notified about the violence outside
When Gen. Chawalit presided in the meeting at the Metropolitan Police Headquarter, Gen. Chawalit ordered and informed the assembly that the cabinet’s resolution was that the house meeting for government’s policy declaration must be made possible definitely on the next day. He then ordered the task to be finished before 5am. Therefore, it is reasonable to believe that the Prime Minister as the head of the government had ordered the National Police Office to take charge to drive away the rallying people surrounding the parliament, in order to enable the policy declaraction on October 7, 2008. The National Police Office by Pol. Gen. Patcharawat had to follow the order of the Prime Minister by whom Deputy Prime Minister Gen. Chawalit was authorized.
When the dispersal of the rally was carried out with explosive teargas from China, it resulted in a lot of people injured and severely injured since the morning time.
Despite obvious realization then that morning crackdown had caused injuries and severe injuries to people, the Prime Minister as the head of the government, instead of ordering a termination of the use of teargas in dispersal of the rally, did not do so. Still, he let the use of force and teargas go on to disperse the later rallies again, in order to pave way for the Members of Parliament, the Senators, and the cabinet to exit the House of Parliament after finishing the declaration.
Despite the policy declaration had already finished, the Prime Minister remained ignorant and let police officers continue bombarding and throwing teargas explosives to the people who were
walking pass to help the people trapped near the House of Parliament, and to the people who were walking back to Makawan bridge, resulting in a lot of people’s casualties and a death in front of the Metropolitan Police Headquarter and the Statue of King Chulalongkorn plaza.
Somchai testified that he entered the parliament through the side gate about 9:30 am. There was no violent situation at that time. While he was making the policy declaration speech, he heard a senator protesting by shouting which was against the parliament’s regulations. He could not get the message what was the senator’s protesting against. He finished the speech at 11:30 am and did not hear any explosion. After finish, he was then informed.
The subcommittee believes that while Somchai was entering the parliament, despite absence of violent situtations, he must have observed the road conditions and noticed the traces of rally dispersal as a lot of water bottles scattering on the road. He must have known what had happened or could have asked for an immediate report from the responsible officers.

Moreover, during the government’s policy declaration, Senator Miss Rosana Tositrakul and Senator Mr.Prasong Nurak stood up to protest. Senator Prasong stated that he protested the Prime Minister who declared the policy of public participation in politics whereas just outside the parliament, a lot of people were injured in the rally. Then his microphone was turned off. Senator Rosana raised her hand to protest and said, “I think the PM is wrong to make a declaration of government’s policy today because out there, there are a lot of people injured. Your policy is a piece of paper but the injured people out there are real. Your wish the parliament to be just a rubber stamp to validate the government is wrong.” Her microphone then was turned off.
After that the government’s MPs angrily booed and many MPs threateningly surrounded and abused the senators, “You are bad. You are not worth living.” The subcommittee believes that Somchai must have heard the protesting Senator Prasong and Senator Rosana because the boo followed after the senators had made the protesting statements.
Despite that, Somchai testified that only after the speech, he was notified, which the subcommittee can deduct that Somchai by then realized about the morning events. Moreover, Gen. Chawalit’s announcement of his resignation in the same morning to express his responsibility in that morning rally dispersal, indicates that Somchai must have known about the situations and the losts from the morning rally dispersal.
Somchai, Chavalit, some cabinet ministers must be responsible
Therefore, Somchai Wongsawat PM then, as the orderer for rally dispersal and the then Deputy PM Gen. Chawalit who had been authorized to take charge in the rally dispersal and order the crackdown, as well as the cabinet ministers in the meeting who did not oppose the use of force and teargas, must be responsible to the rally dispersal which is considered a violation of human rights and the laws.
Despite Somchai, PM then, and the cabinet were already aware of the results of the morning crackdown, still they let police officers use force and teargas explosives to disperse the rally again in the afternoon, in the evening and at night which resulted in a lot of people injured, severely injured and some deaths. They did not forbid or order cessation too excessive actions of the police. Such cabinet’s agreement is in a scope of abuse of authority in order to inflict damage to others.

Cabinet of Murderers
Additionally, when evidently, there were later, a lot of people injured and severely injured as well as some deaths from too excessive actions of the police which are unlawful, Somchai the PM then, and Gen.Chawalit the Deputy PM then, remained unopposing to the rally dispersal. These unlawful acts –employing others to physically or mentally injure others resulting in serious injuries, to murder or attempt to murder with premeditation — are violations of criminal laws articles 157, 295, 297, 288, 84 .
